In March, Moscow Arbitration Court fully redeemed singer Alla Pugachyova’s ownership rights over the Filipp brand, thus granting her suit requesting the court to void Rospatent’s decision to terminate its legal protection of the contested trade mark in relation to certain goods and services. This dispute arose after a previously unknown company, Filipp, registered in Samara, petitioned the Russian Patent Disputes Chamber to terminate the brand’s legal protection as it had not been used as required for more than three years.
However, the pop diva, the legal owner of the Filipp brand since April 1996, could not participate at the Rospatent meeting that took the contested decision as she was not properly notified. In its decision, the court obliged Rospatent to review the case again and also nullify its termination of the trademark protection.
